Nullification is a political construct that would give the states the power to nullify federal law or regulations. Erroneously interpreting the 10th amendment to the Constitution. This is what the civil war was fought over. The southern states believed they had the power to nullify or not follow federal law when it came to the issue of slavery. The concept of states rights comes out of giving states the right to nullify state law.
More than 600,000 brave Americans died during the Civil War to end nullification and states' rights. We would be doing a disservice to their memory and what they fought for with Nullification. Nullification was used by the southern states during the 1960s to support segregation and toblock the implementation of the Civil Rights Act or Voting Rights Act. Civil rights had to be enforced by US Marshalls integrating schools, buses and giving African American citizens the right to vote.
Under the Supremacy Clause of Article VI, the Constitution and federal laws adopted in pursuance thereof are the "supreme law of the land" and are superior to state law. Federal laws therefore cannot be negated by the states, so long as those laws were adopted in pursuance of—that is,consistent with—the Constitution. Whether a federal law is consistent with the Constitution is a matter of interpretation of the law, which is inherently a judicial function. The federal judicial power granted by Article III of the Constitution gives the federal courts authority over all cases arising under the Constitution and federal laws. The federal courts therefore have the power to determine whether federal laws are constitutional, with the Supreme Court having final authority.
